We Bought a house in gated community (HOA) in 1995. When we moved in A community trees and sanction by HOA, planted by devoplaper. A tree planted few feet from sidewalk ( common Area maintained by HOA). It 's root may cause buckles of side walk. Who responsible for repair? Do we have right to remove the tree, since it's root may cause damage again. Who is responsible, if the tree causing damage again,if HOA refuse to let me remove the tree? Any other options? Can cutting the tree rots causing the tree to die/tumble. It is ? jackaranda tree.

Let an attorney help you with this problem. He/she will visit with the proper people and solve your problem. You won't have to do a thing.
Reply:Trees will not cause damage to a PROPERLY installed concrete sidewalk. Concrete guys will deny this but it is true.
Reply:If the tree is in the common area, then it is the association that is responsible for its repair or removal.
You can volunteer to remove the tree and save them a fortune in having it hired out.
Encourage them by saying "I hope no one trips over the buckled sidewalk and sues the association or me."
Always contact your board or association in writing and keep a copy, you will need if there is a lawsuit filed to protect yourself
