You pretty much HAVE to lock it in place- why bother at all if you don't? Kind of defeats the purpose, don't you think?
Nearly all child safety seats have a hotline you can call for your state's laws listed on the seat- which you should call for specifics, as the laws vary by state to state. If you call them, they should be able to answer the "when is the right time for a booster seat" debate/question.
Good luck, but you should do it soon- I know in PA they have very steep fines for those who don't have children properly secured, aside from the fact that they can be seriously injured or worse.

You do not lock it in place with a booster seat. The belt will lock upon an accident. Your local volunteer fire department will confirm this. In addition the fine in PA is a secondary fine and is $10. ($51.50 including all costs). Report It
